By accessing or using our website, digital platforms, CRM systems, or any services provided by GCBS Digital (“Company,” “we,” “our,” or “us”), you agree to comply with and be bound by these Terms of Service.
If you do not agree, do not use our website or services.

SMS and email communication services

Service features may vary based on your package, subscription level, or custom agreement.

3. Eligibility

By using our services, you confirm that you:

Are at least 18 years old

Are legally able to enter into these Terms

Are providing accurate and truthful information

4. Client Responsibilities

Clients agree to:

Provide accurate project details, branding, and access credentials

Respond promptly to approvals or revision requests

Maintain the security of their login credentials

Not use our services for illegal, abusive, deceptive, or harmful activities

5. Payments & Billing

Recurring Services

Monthly or yearly services automatically renew unless canceled.
By subscribing, you authorize us to charge your payment method on file.

Refunds

Due to the digital and customized nature of our services, refunds are generally not provided, except where required by law.

Late Payments

Failure to pay may result in suspension of services, including website hosting, CRM access, and automations.

6. Intellectual Property

Unless otherwise specified in your contract:

You own your business content, logos, and brand assets.

We own all internal systems, processes, templates, and proprietary automations.

Some licenses (templates, plugins, AI setups, or integrations) may be provided to you as long as you remain an active subscriber.

7. Limitation of Liability

We are not liable for:

Loss of revenue

Data breach caused by third-party platforms

Downtime caused by hosting providers or software partners

Errors resulting from client-provided content

Any damages exceeding the total amount paid to us in the last 90 days

Our services involve external platforms (GoHighLevel, Twilio, Stripe, Google, Meta, etc.). Their terms and limitations also apply.

8. Third-Party Tools & Integrations

By using our services, you acknowledge that we commonly integrate third-party services to deliver functionality.
We are not responsible for outages, policy changes, errors, or data handling by these providers.

SMS Messaging Program

Gomesii Consulting & Business Systems (GCBS) Notifications.
This program sends appointment confirmations, 24-hour business strategy session reminders, and follow-up communication regarding digital service implementations and CRM support.

You can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or reach out directly to {support email address or toll-free number}.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

You may terminate your subscription at any time; however, fees already paid are non-refundable.

We may update or modify these Terms at any time.
Changes take effect when posted on this page. Continued use of our services indicates acceptance of any updates.

13. Governing Law

These Terms are governed by the laws of Ontario, Canada.
Any disputes will be handled in the appropriate provincial courts.
